This EarnIn Card Autopay Agreement (“Autopay Agreement”) is made between you (“you” or “your”) and Evolve Bank & Trust (“we”, “us”, “our”) and sets forth the terms and conditions of your use of our automatic payment service to pay down your Card Balance (“Autopay”). Autopay authorizes the transfer of funds from your Secured Account with us and from your external bank account linked in the EarnIn app (“Linked Bank Account”). This Autopay Agreement will govern Autopay. Capitalized terms in this Agreement have the meaning assigned to them in your Cardholder and Security Agreement unless otherwise stated herein.
Your Cardholder and Security Agreement with us requires you to pay your Statement Balance in full by the Payment Due Date provided in your EarnIn Card Statement. By entering into this Autopay Agreement, you are choosing to use Autopay as further described below:
you authorize us to initiate automatic payments of funds from your Secured Account to repay your Card Balance, on or around the 1st and 15th day of each and every month and
you authorize us to initiate payments from your Linked Bank Account on or around your next payday, with 3 (three) Business Days advance notice, in the event your Secured Account does not cover the Card Balance.
This Autopay Agreement does not apply if (1) you have instructed us to stop a specific payment, or (2) you have revoked this authorization, or (3) your EarnIn Card Statement Balance is paid in full.
How it works
With Autopay, we will automatically deduct payments on or around the 1st and 15th of every month from your Secured Account up to the amount of your Card Balance. If your Card Balance is higher than the amount of funds in your Secured Account, we will transfer the full amount in your Secured Account to make a partial payment of your Card Balance. If the Secured Account transfers are not successful in paying your Card Balance, we will schedule a payment from your Linked Bank Account on or around your next payday and provide three (3) Business Days notice of the debit and its amount. You may access your scheduled Autopay payments and any past payments using Autopay by accessing and viewing your EarnIn Card Account in the EarnIn Mobile App.
You acknowledge that the amount of each payment you authorize (whether from your Secured Account or a Linked Bank Account) may vary from the amount of the previous payment based on your Card Balance and the funds available in your Secured Account and Linked Bank Account. All payments will be between $0 and the amount of your Card Balance (the “Range”). You have the right to receive notice of any payment that varies in amount from the previous payment, but agree that you will only receive notice where such payment falls outside of the Range. You acknowledge that you may view your Card Balance at any time in your Card Account on the EarnIn Mobile App.
In addition, you agree and authorize us to make any debits or credits to your Secured Account and Linked Bank Account that are necessary and required to correct any errors to that account. If the authorized debit date is not a Business Day, the payment will be processed on the next Business Day. For purposes of this authorization, "Business Day" means Monday through Friday, excluding federal banking holidays. If any Autopay payment attempt fails, you agree and authorize us to re-initiate such payment as permitted by law and applicable payment network rules.
How to Cancel Autopay
This authorization will remain in full force and effect until you notify us that you wish to revoke this authorization by A) toggling off the Autopay setting in the EarnIn mobile application or B) emailing care@earnin.com, or by contacting the EarnIn team via live chat in the EarnIn mobile application. If you choose to revoke via option A, you acknowledge that you must notify Evolve through its Servicer, EarnIn, at least one (1) Business Day before your next scheduled transfer date in order to cancel your authorization. If you choose to revoke via option B, you acknowledge that you must notify Evolve through its Servicer, EarnIn, at least three (3) Business Days before your next scheduled transfer date in order to cancel your authorization.
If Evolve does not receive notice within these respective timeframes before the scheduled debit date, Evolve may attempt, in its sole discretion, to cancel the debit transfer. However, Evolve assumes no responsibility for its failure to do so. You acknowledge and agree that the withdrawal of your authorization contained herein will not apply to ACH transactions performed before the withdrawal of your authorization becomes effective.
You acknowledge that you have received a copy of this Autopay authorization and can access it at any time through your EarnIn Card Account in the EarnIn Mobile App. Please retain a copy of this Autopay Agreement with your records as it contains your agreement and authorization to use our Autopay services to remit payments from your Secured Account to your EarnIn Card Balance.
