Preauthorization for Recurring Electronic Funds Transfers from Your Deposit Account to Your External Bank Account
By agreeing to this Paycheck Router Preauthorization for Recurring Electronic Funds Transfers (“Preauthorization Agreement”), you are hereby consenting to and authorizing Evolve Bank & Trust (“Evolve”) to initiate recurring electronic funds transfers from your Deposit Account at Evolve to your linked external bank account in the EarnIn mobile app (“Bank Account”). Evolve will debit your Deposit Account, and make the corresponding credit entry/entries to your Bank Account, on the same day that your paycheck is received/made available via direct deposit in your Deposit Account. Capitalized terms in this Preauthorization Agreement that are not otherwise defined herein, shall have the meaning assigned to them in your Cardholder and Security Agreement that governs your EarnIn Card (“Cardholder Agreement”), the EarnIn Cash Out User Agreement, and/or the FAQs on EarnIn’s website.
The amount of such electronic fund transfers shall vary and shall be determined in accordance with the range of amounts as described below:
The actual amount transferred may be less than your election if your paycheck is lower than expected, or if your paycheck does not cover your Earnings Spent (including any voluntary tips you elected to give to EarnIn pursuant to Cash Out User Agreement and any fees for voluntary expedited transfers with Lightning Speed, as defined and disclosed within the EarnIn mobile application). EarnIn may, at its discretion, limit your Pay Period Max to ensure you have sufficient funds to fulfill your Paycheck Router election.
You elect to only receive notice of varying amounts of debits under this Preauthorization Agreement if the debit amount deviates from the amounts described above.
Evolve will make the electronic fund transfer described above on each Business Day to the extent your Deposit Account has a positive balance.
You further authorize Evolve to debit or credit the Deposit Account and Bank Account in the amount necessary to correct any erroneous debits or credits, as applicable.
You acknowledge and agree that your authorization for Evolve to initiate recurring electronic fund transfers from your Deposit Account to your Bank Account will remain in full force and effect until you A) revise the amount elected in your Paycheck Router settings or toggle off the Paycheck Router in the EarnIn mobile application, OR B) notify EarnIn directly that you wish to revoke this authorization by emailing care@earnin.com, or by contacting the EarnIn team via live chat in the EarnIn mobile application. If you choose to revoke via option A, you acknowledge that you must notify Evolve through its Servicer, EarnIn, at least one (1) Calendar Day before your next scheduled transfer date in order to cancel your authorization. If you choose to revoke via option B, you acknowledge that you must notify Evolve through its Servicer, EarnIn, at least three (3) Business Days before your next scheduled transfer date in order to cancel your authorization. If Evolve does not receive notice within these respective timeframes before the scheduled debit date, Evolve may attempt, in its sole discretion, to cancel the debit transfer. However, Evolve assumes no responsibility for its failure to do so. You understand that if you call to cancel your authorization, we may require you to put your request in writing and provide your written request to EarnIn within fourteen (14) calendar days after you call. If we do require you to put your request in writing, your oral request to cancel your authorization will cease to be binding after fourteen (14) days. Please note that revoking this authorization will not cancel any payment that is initiated before your revocation becomes effective.
You acknowledge and agree that the withdrawal of your authorization contained herein will not apply to ACH transactions performed before the withdrawal of your authorization becomes effective.
